Recent Changes To Maryland’s DWI/DUI Laws

Noah’s Law, also known as the Drunk Driving Reduction Act of 2016, Alex and Calvin’s Law and other newly introduced statutes create several important revisions to drunk driving laws in Maryland. The Changes To Maryland’s DUI Laws

The changes to the law include heavier penalties for driving under the influence of drugs or alcohol as well as an expansion of the ignition interlock program. New policies also make parents liable for minors who drink at their homes and then go on to cause injuries or death in a car crash. Consequences were already severe for drunk driving charges in Maryland, but they are even steeper as of October 1, 2016.

The new penalties include:

  • Installation and use of an ignition interlock device for six months after failing a police-issued breath test with a blood alcohol content reading of .08 or higher
  • Installation and use of an ignition interlock device for nine months or driver’s license suspension for refusing to take a police-issued breath test
  • Up to a year in jail for parents who allow minors to drink at their homes, who then leave and hurt themselves or others in a car crash
  • Up to 15 years in jail and fines of $15,000 for people convicted of vehicular manslaughter after previous charges of driving while impaired by drugs or alcohol

Additionally, the length of time you must use an ignition interlock device increases for subsequent offenses.
