Maryland worker injured after falling into a sewer

| Oct 15, 2011 | Workers' Compensation

Job related injuries are commonplace in the construction industry, where workers are surrounded with dangerous equipment and scaffolding. Construction workers need to deal with assignments that put them in potentially hazardous situations. Recently, a construction worker in Gaithersburg, Maryland, suffered serious personal injury when he accidentally fell into an uncovered storm drain at his worksite.

Preventing on-the-job injuries falls under the jurisdiction of the Occupational Safety and Health Administration, but accidents still happen. Hazardous areas are supposed to be visibly marked to prevent worker injury. An investigation into the facts of this accidental fall is in progress. The worker was taken to a local Maryland hospital for treatment of non-life-threatening injuries.

In this situation, the storm drain opening should have been covered or marked as dangerous to avoid worker injury. The investigation of the accident involves the Maryland Department of Labor’s Occupational Safety and Health division. So far, officials declined comment about the incident.

Work injuries are common, but preventable, and all precautions to mark hazardous areas are required under local and Federal safety standards. OSHA rules should be posted at the worksite, so a clear understanding of hazards and precautions is available to supervisors and workers. Claims for work injuries must be made in a timely manner, with proper procedures.

Although injured workers are entitled to compensation for their injuries, the workers’ compensation system can be confusing for injured workers. A workers’ compensation lawyer is the right type of attorney to contact if you have been injured in a work accident. Workers’ compensation attorneys can help injured workers pursue fair compensation for their injuries within the legal system.
