Negligence factors in two serious accidents in Maryland

| Oct 18, 2011 | Car Accidents

Recently, a pleasant ride on an Anne Arundel County road in Maryland turned into a fatal accident for an unfortunate bicyclist. The bicyclist was struck from behind by a driver who said he did not see the rider in time to avoid the accident. The road did not have a bike lane or shoulder, and there was little natural lighting when the collision happened at 7:30 p.m. The bicyclist only had a makeshift headlight turned on and a small red LED flasher on the rear of the bike that may not have been turned on at the time of the accident.

Poor visibility, lack of adequate safety precautions and other factors often prove to be significant in personal injury accidents, and those elements may even lead to a fatality in cases like this. Poor lighting, poor visibility, a narrow road with no escape lane and possible driver error can easily combine to create a wrongful death situation for both parties. The deceased still has rights for compensation that pass along to survivors.

Liability and negligence are important factors in any personal injury case. Determining liability in fatal accidents like this or in personal injury accidents like another recent car accident that resulted in injuries to a police officer is an important part of a personal injury attorney’s job.

In the accident involving the officer, an investigation found that a driver failed to yield to the officer’s right of way on Fort Smallwood Road in Orchard Beach. The resulting collision sent both drivers to hospitals for their injuries.
