As a worker, you have the right to a safe and productive workplace. The Occupational Safety and Health Administration works will all companies to make sure workers aren’t put in harm’s way either intentionally or unintentionally. There are a number of standards and regulations that OSHA requires, making it illegal to break those rules. If you’ve been hurt at work because of your company failing to follow safety procedures, then you likely have a case against them and may be entitled to extra compensation outside of your typical workers’ compensation.
Under OSHA, you have several rights and responsibilities. For instance, you have the right to receive the copies of tests done to locate hazards in the workplace. You have the right to ask OSHA area director to inspect your workplace if you think it may be dangerous to you or others. You have the right to have your name withheld from your employer to prevent retaliation of any type, since you have the right to remain anonymous.
You also have the right to review records regarding work-related injuries and illnesses at your place of employment. You can access relevant notes about exposure and medical records regarding OSHA violations or accidents. You also have the right to review all copies of the standards, rules, requirements and regulations OSHA provided to your employer.
If you’ve been hurt at work and your employer didn’t provide you with access to OSHA safety standards or didn’t give you the right training, you may have the right to compensation. Speak with someone familiar with OSHA and workers’ compensation to discuss your legal rights.
