Update on Cardiac Stent Medical Malpractice Matter

In a blog post from August, we reported on a medical malpractice case that has prominently resurfaced in the news, as developments in the matter continue to go forward on several fronts. We update the story here.

The matter involves allegations that Dr. Mark G. Midei placed stents unnecessarily into hundreds of patients during the period he supervised the St. Joseph Medical Center cardiac catheterization lab in Towson.

The hospital revoked Midei’s privileges there and notified many hundreds of his patients of the potential harm to them. The state’s Board of Physicians – the regulatory board that licenses doctors in Maryland – brought an administrative action against Midei, the result being that he could lose his license. Federal authorities also subpoenaed hospital records in a Medicare fraud investigation, which the hospital has apparently settled with the government.

That still leaves much more. Two lawsuits were filed this past January, one n Baltimore County and another in the city seeking class action status. Negotiations have now broken down between St. Joseph Medical Center and more than 100 of the patients who received cardiac stents concerning their monetary claims for damages against the hospital. Their malpractice claims will now likely be filed in the state’s Health Care Alternative Dispute Resolution Office, an arbitration body. If talks break down there, the claims can be taken to court.

Dr. Midei and the hospital are bracing for an onslaught of additional litigation, given the nearly 600 warning letters sent by the hospital to stent-implanted patients.
