Protection Against Minimally Insured And Totally Uninsured Drivers

Uninsured motorist coverage is required in Maryland, though you can purchase higher limits as part of your insurance policy. This type of coverage protects you in the event that you or your passengers are injured by a driver without insurance or with less insurance coverage than you have purchased for yourself. These claims normally do not affect your insurance rates.

Uninsured motorist coverage or underinsured motorist coverage (UM/UIM coverage), as it is sometimes referred to in the following instance, also provides compensation if you are in an accident with a driver who has minimal insurance coverage. Making An UM/UIM Claim

The first thing you should do after getting in a car accident with an uninsured driver is to file a claim with your own auto insurance provider. Maryland law requires all motorists to have some form of UM/UIM coverage, so you should be covered. You have three years from the date you knew or reasonably should have known you have a claim to file a lawsuit. This time limit generally starts from the date you learn that the driver who injured you lacks sufficient collision insurance coverage.

However, getting your claim approved is not automatic. Just like with any other car accident claim, your insurance company probably will be reluctant to pay out. No matter how valid your claim is, and the fact that this is your insurer, the claims adjuster will search for a reason to deny it or make a settlement offer that is much lower than your damages. They could allege that your injuries were preexisting before the crash or that you are exaggerating or outright making them up. Or the adjuster might also claim you were responsible for the accident.
